Terms of Use

These Terms of Use ("Terms") govern access to and use of KanisaPro, a complete church management platform operated by Novara Software ("Novara", "we", "us", "our"), available at https://novarasoftware.ai and related applications.

By creating a church account, signing in, or using KanisaPro, you agree to these Terms on behalf of your church and any authorised users you invite. If you do not agree, do not use the service.

KanisaPro is a complete church management system for members, attendance, giving, finance, communications, and related ministry operations. The service can also work without a constant internet connection on supported devices and sync when connectivity is available.

Features, plans, and availability may change over time. We will use reasonable efforts to maintain the service but do not guarantee uninterrupted access, error-free operation, or compatibility with every device or network.

Church accounts are created by an owner or authorised representative. You are responsible for the accuracy of registration information, safeguarding login credentials, and all activity under your church account.

You must ensure that team members and volunteers you grant access to are authorised by your church and use the platform lawfully. You must notify us promptly if you suspect unauthorised access.

KanisaPro is licensed on a subscription or prepaid basis. Fees are payable to Novarasoftware.ai by bank deposit or other methods we specify. Licence activation may require verification of your deposit reference.

All fees are non-refundable. This includes, without limitation: trial conversions, monthly, quarterly, yearly, and lifetime licence payments; SMS or messaging credits; setup or activation fees; partial billing periods; and deposits made in error, duplicate, or excess of the required amount.

No refunds are provided for unused time, early cancellation, change of mind, or failure to use features included in your plan. By submitting payment, you acknowledge and accept this non-refundable policy.

Failure to pay applicable fees may result in suspension or termination of access until payment is resolved.

You agree to use the service only for lawful church and ministry purposes. You must not:

• Violate applicable laws or infringe the rights of others
• Upload malicious code, attempt unauthorised access, or interfere with the platform
• Scrape, reverse engineer, or copy the software except as permitted by law
• Use the service to send spam, harassment, or misleading communications
• Resell or sublicense access without our written consent

Your church retains ownership of the data you enter into the platform, including member records, giving, attendance, and pastoral information. You are responsible for the accuracy, lawfulness, and appropriate use of that data, including obtaining any consents required under applicable law.

You are responsible for backups and exports where needed for your own records. We provide export tools, but you should maintain independent copies of critical church data.

KanisaPro, including its software, design, branding, and documentation, is owned by Novara Software and protected by intellectual property laws. These Terms do not transfer any ownership rights to you except the limited right to use the service according to your licence.

The service is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where applicable.

To the maximum extent permitted by law, Novara Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from your use of the service.

Our total liability for any claim relating to the service shall not exceed the fees paid by your church to Novara for the service in the twelve (12) months preceding the event giving rise to the claim.

We may suspend or terminate access if you breach these Terms, fail to pay fees, or if continued provision poses legal, security, or operational risk. You may stop using the service at any time.

Upon termination, your right to use the service ends. Provisions that by nature should survive (including payment obligations, disclaimers, and limitations of liability) will remain in effect.

These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict-of-law principles. Courts in Tanzania shall have exclusive jurisdiction over disputes arising from these Terms, subject to mandatory consumer protections where applicable.

We may update these Terms from time to time. The effective date at the top of this page will change when we do. Continued use after changes constitutes acceptance of the updated Terms.
